4. Text Messaging (SMS) Program
This section applies to text messages between you and Sierra BLS and also serves as the terms of our text messaging program.
Our messaging platforms. We send and receive calls and text messages through business communication platforms, currently Zoom Phone and RingCentral, together with the texting and call-handling tools integrated with those platforms. We may use more than one platform at a time, so you may receive messages from different numbers that belong to us. This policy applies the same way no matter which platform or number delivers a message, and your opt-out choice is honored across all of our numbers.
How you opt in. We send text messages only to people who have agreed to receive them. You give us that consent when you:
- Provide your mobile number and accept the text messaging disclosure on our online registration form or a website contact form
- Provide your mobile number and agree to receive texts on a paper or digital intake form or agreement
- Give us verbal consent when registering or speaking with us by phone or in person
- Agree by email to receive text messages
- Text our business number first, which we treat as consent to reply to you about your inquiry
Consent to receive text messages is not a condition of purchasing or registering for any class.
What we send. Messages are tied to your class registration or your inquiry. They include:
- Class confirmations and reminders, including date, time, location, parking, what to bring, and pre-course requirements such as completing the online portion of a blended course
- Class updates, such as schedule, room, or instructor changes, weather or emergency cancellations, and reschedule options
- Certification notices, including confirmation that your eCard has been issued and how to claim it, and renewal reminders if you asked to be reminded
- Customer service replies in conversations you start with us
We do not send marketing or promotional text messages under this program. If we ever offer promotional texting, it will be a separate program that requires your separate opt-in.
Message frequency and cost. Message frequency varies. A typical student receives two to five messages per class. Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages.
How to opt out or get help. Reply STOP to any message to cancel at any time. Opt-out works by replying to the same number that texted you. You will receive one final message confirming that you have been unsubscribed, and we will not text that number again unless you opt in again. Reply HELP for help, or contact us at Info@SierraBLS.com or (775) 235-2117. If you opt out of texts, we may still contact you by email or phone about a class you are registered for.
No sharing of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. The communication platforms and carriers that deliver our messages (currently Zoom Phone and RingCentral) act as our service providers, process your mobile number only to transmit our messages, and are not permitted to use it for their own purposes.
5. Phone, Email, Chat, and Automated Tools
Phone calls. Calls to and from our business numbers are handled through Zoom Phone and RingCentral, which keep call logs and voicemails for us. If we record a call, we will tell you at the start of the call.
Email and support requests. We use Google Workspace for email and Zendesk to manage support requests. When you email, text, call, or message us, your message may become a support ticket so our team can track and answer it.
Website chat and social messaging. If you contact us through the chat feature on our website, WhatsApp, Facebook Messenger, Instagram, or another social platform, that platform's own privacy policy also applies to your use of it.
Automated and AI-assisted tools. We may use automation and AI-assisted tools to route messages, draft replies, and prioritize requests. These tools process the content of your message to help us respond accurately and quickly, and a member of our team is responsible for our responses. We do not use these tools to make decisions with legal or similarly significant effects on you.
6. How We Share Information
We share personal information only as described in this section. We do not sell it, and we do not share it with third parties or affiliates for their marketing or promotional purposes.
- Service providers that work on our behalf. These companies process information only to provide services to us and are not permitted to use it for their own purposes. They currently include Enrollware (class scheduling and registration), Stripe (payment processing), Zoom Phone and RingCentral (phone and text messaging), Zendesk (customer support), Google (Workspace for email and documents; Analytics and Tag Manager for website analytics), Zapier (connecting our systems and automating notifications), and our website hosting and security providers.
- Credentialing and regulatory organizations, as required to issue, report, or verify your certification or continuing education credit: the American Heart Association and our AHA Training Center (currently CPR Suppliers), the National Association of Emergency Medical Technicians (NAEMT), the Nevada State Board of Nursing, and the Nevada State Board of Medical Examiners.
- Your employer, school, or sponsoring organization, when it registered or paid for your class, or when you ask us to confirm your certification to it.
- Payment processors, card networks, and banks, when needed to process a payment or refund or to respond to a payment dispute or chargeback. This may include providing registration records, communications, attendance records, and security footage that document the transaction and the services provided.
- Legal and safety purposes, when we believe disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, property, or safety of our students, staff, business, or others.
- Business transfers, if our business or part of it is sold, merged, or reorganized, in which case personal information may be transferred to the successor, who will remain bound by this policy until it is updated.
- With your consent, for anything else you ask us to do or agree to.
Text messaging exclusion. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
7. Cookies, Analytics, and Advertising
Our websites use cookies and similar technologies. Cookies are small files placed on your device that help the site work and help us understand how it is used.
- Essential cookies keep the site secure and working, including the cookie notice itself and the forms you submit.
- Analytics cookies, including Google Analytics loaded through Google Tag Manager, tell us which pages are visited, how visitors arrive at the site, and how the site performs, so we can improve it. Google may collect information about your activity across websites through these tools, subject to Google's privacy policy.
- Advertising cookies may be used to measure our advertising and to show ads for our classes to people who have visited our site, through platforms such as Google and Meta. These platforms may collect information about your online activity across different websites.
You can control cookies through your browser settings, opt out of Google Analytics with Google's browser add-on, and adjust ad personalization at adssettings.google.com and in your Meta account settings. Blocking cookies may affect some site features. Our websites do not currently respond to Do Not Track or Global Privacy Control browser signals.
8. How Long We Keep Information
- Training and certification records: for as long as required by the AHA, NAEMT, the Nevada State Board of Nursing, and other credentialing bodies, and as needed to verify your certification history, which may be several years after your class.
- Registration, payment, attendance, and communication records: for as long as needed to provide our services, apply our Terms and Conditions, resolve disputes, and respond to payment disputes, and for the period required by tax and business record laws.
- Security video: for a limited period, unless footage is needed to document an incident or dispute, in which case we keep the relevant footage until the matter is resolved.
- Website analytics: according to the retention settings of our analytics tools.
- Text messaging opt-out records: indefinitely, so that we do not text you again unless you opt back in.
When information is no longer needed, we delete it or de-identify it securely.
9. How We Protect Your Information
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted connections (HTTPS) on our websites, access controls that limit staff access to what their role requires, and PCI-compliant payment processing through our payment processor. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a security breach affects your personal information, we will notify you as required by law.
10. Your Rights and Choices
You can:
- Access and correct your information: request a copy of the personal information we hold about you, or ask us to correct it.
- Request deletion: ask us to delete your personal information. We will honor your request except where we must keep records to meet credentialing, legal, tax, or dispute-resolution obligations, in which case we will tell you what we kept and why.
- Stop text messages: reply STOP to any text (see Section 4).
- Stop marketing emails: use the unsubscribe link in any marketing email, or contact us. You will still receive service emails about classes you are registered for.
- Control cookies: see Section 7.
To make a request, email Info@SierraBLS.com or call or text (775) 235-2117. We may need to verify your identity, usually by confirming details from your registration, before acting on a request. We aim to respond within 45 days. We will not treat you differently for exercising these rights.
11. State Privacy Rights
Nevada residents. We are a Nevada business, and Nevada law (NRS Chapter 603A) requires us to tell you the following. The categories of covered information we collect through our websites are described in Section 2, and the categories of third parties with whom we share it are described in Section 6. You may review and request changes to any covered information we have collected about you by contacting us as described in Section 10. Third parties, such as the analytics and advertising providers described in Section 7, may collect information about your online activities over time and across different websites when you use our site. We do not sell covered information as defined by NRS 603A. Even so, you may submit a verified request directing us not to sell your covered information through our designated request address: Info@SierraBLS.com or (775) 235-2117. We will respond within 60 days. We will tell you about material changes to this policy as described in Section 14.
Residents of other states. If you live in a state with a comprehensive consumer privacy law, you may have additional rights, including the right to access, correct, delete, or receive a copy of your personal information, and to opt out of the sale of personal information, targeted advertising, or profiling. Many of these laws apply only to businesses above certain size thresholds, which we may not meet, but we extend the rights in Section 10 to everyone regardless of where you live, and we do not sell personal information or use it for profiling. You may submit a request as described in Section 10, and if we decline a request you may appeal by replying to our response.
12. Children and Minors
Our websites and services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13. Minors may attend certain classes, such as Heartsaver courses, when a parent, guardian, school, or employer registers them. In that case we collect only the information needed to deliver the class and issue the certification, and the registering adult or organization is responsible for the information provided. If you believe a child has given us information without appropriate consent, contact us and we will delete it.
13. Third-Party Websites and Services
Our websites link to third-party sites and services that we do not control, including the AHA eCard portal, NAEMT, Enrollware, Stripe, and social media platforms. Their privacy policies, not ours, govern the information they collect. Please review them before providing information.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will post the revised policy on our website with a new effective date. If we make a material change to how we use or share personal information, we will also notify you by email or by a prominent notice on our website before the change takes effect. Your continued use of our services after the effective date means the updated policy applies.
